By accessing and using the website at jakes-bakes.com(the “Site”) and purchasing products from Jake's Bakes LLC(“we,” “us,” or “our”), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our Site or purchase our products.
Jake's Bakes LLC is a limited liability company organized under the laws of the State of New York, with its principal place of business in Schodack, NY 12033. We conduct business exclusively within the State of New York. These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
All products are subject to availability. We reserve the right to discontinue any product at any time without notice. Prices for our products are subject to change without notice.
Placement of an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, errors in pricing or product information, or suspected fraud.
All prices are listed in US dollars (USD) and are subject to applicable New York State sales tax. We make every effort to display accurate pricing; however, errors may occur. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price and will notify you of such cancellation.
Custom cake and specialty orders require a deposit at the time of order placement. The specific deposit amount will be communicated at the time of ordering. Custom orders must be placed at least 48 hours in advance. Modifications to custom orders must be requested at least 24 hours before the scheduled delivery or pickup time and are subject to availability.
We offer free local hand-delivery within approximately 1 hr of Castleton-on-Hudson, NY, covering select areas within the State of New York. Delivery outside our standard area may be available for an additional fee and is subject to our discretion.
Delivery times are estimates and are not guaranteed. We will make reasonable efforts to deliver within the agreed-upon time window. We are not liable for delays caused by circumstances beyond our control, including but not limited to weather, traffic, or other unforeseen events.
Someone must be available to receive the delivery at the specified address and time. If we are unable to complete delivery due to no one being available, we may reschedule delivery at our discretion, and an additional delivery fee may apply.
Payment must be made in full at the time of order placement, unless otherwise agreed upon for custom orders. We accept the following payment methods: credit/debit cards processed through our online checkout, and Venmo (@JakesBakesLLC). All payments are processed securely through third-party payment processors.
Standard orders may be cancelled up to 12 hours before the scheduled delivery or pickup time for a full refund. Cancellations made less than 12 hours before the scheduled time will be subject to a 50% cancellation fee.
Custom orders may be cancelled up to 48 hours before the scheduled delivery or pickup time. Deposits on custom orders cancelled within 48 hours of the scheduled time are non-refundable.
If you receive a product that is damaged or does not match your order, please contact us within 4 hours of delivery at 518-573-4480 or Contact@Jakes-Bakes.com. We will, at our option, provide a replacement or a full refund. Because our products are perishable food items, returns are not accepted.
Our products are made in a kitchen that handles common allergens, including but not limited to wheat, dairy, eggs, soy, tree nuts, and peanuts. While we take precautions, we cannot guarantee that any product is free from allergens. If you or someone in your household has a food allergy or dietary restriction, please contact us before placing an order so we can discuss options.
All content on this Site, including but not limited to text, graphics, logos, images, and product descriptions, is the property of Jake's Bakes LLC and is protected by United States intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our express written permission.

To the maximum extent permitted by applicable law, Jake's Bakes LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Site or purchase of our products. Our total liability for any claim arising from these Terms or your use of our products shall not exceed the amount you paid for the specific product giving rise to the claim.
You agree to indemnify, defend, and hold harmless Jake's Bakes LLC, its owners, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of another party.
Any disputes arising out of or related to these Terms or your use of our Site or products shall be resolved exclusively in the state or federal courts located in Rensselaer County, New York, and you consent to the personal jurisdiction of such courts. You waive any right to a jury trial in connection with any such dispute.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
